CheapCash Promotional Program Terms & Conditions

The CheapCash promotional program (“CheapCash Program” or the “Program”) is offered only to registered users of CheapTickets.com (the “Website”) and is open only to individuals who are eighteen (18) years of age and older and have a valid email address. CheapCash is a promotional offer by CheapTickets in which members are offered the opportunity to earn CheapCash on Eligible Flight bookings.
The CheapCash Program offers “CheapCash” on certain bookings, which can be redeemed on eligible CheapCash Hotels, subject to these Terms and Conditions and the availability of eligible travel and reward items. The terms “You” and “Your” throughout these Terms and Conditions refer to any member and any person eligible to participate in the Program, as applicable.
The Program has no predetermined termination date and may continue until such time as CheapTickets decides to terminate the Program. CheapTickets may terminate the Program at any time with or without prior notice to You.
Definitions
“CheapCash” is the base unit of measurement in the Program. The value of one (1) dollar in CheapCash is equal to a credit of one (1) US Dollar on a CheapCash Hotel.
“CheapCash Hotel” means a pre-paid, stand-alone (i.e., not part of a package) hotel available to be booked on CheapTickets.com that shows a “CheapCash applied” message for that hotel in the search results on CheapTickets.com.
“CheapCash member” or “member” means any person who has registered for the CheapCash Promotional Program and is eligible to earn and redeem CheapCash.
“Eligible Flight” means a stand-alone (i.e., not part of a package) flight that is booked on CheapTickets.com or the CheapTickets mobile app for which an “Earn CheapCash” message appears in the search results.
Membership and Enrollment
You must have an account on CheapTickets.com in order to register for the Program. Registered members of CheapTickets.com are not automatically enrolled into the CheapCash Program and will require a separate join. To enroll in the Program, You must check the box on the “Checkout: Review and book” page for Eligible Flights indicating that you would like to receive CheapCash for that booking.
As an enrolled member of the Program, You will receive regular account servicing updates by email and other email notifications, including marketing emails.
Membership in the Program is not transferable. You are responsible for regularly checking Your account and must notify CheapTickets of any omissions, incorrect entries, or other discrepancies.
Information about Your CheapCash account can be accessed via www.cheaptickets.com/account/myclub when logged in with Your Member ID. Information includes but is not limited to Your Member ID, CheapCash balance, and account history (CheapCash earned and redeemed).
Earning CheapCash
You can earn CheapCash with an Eligible Flight booking. Search results must include an "Earn CheapCash" message to constitute an Eligible Flight booking. If You are not already enrolled in the CheapCash Program when completing an Eligible Flight booking, You must check the box on the "Checkout: Review and book" page for that booking indicating that you would like to receive CheapCash for that booking. Once You have enrolled in the Program, if You are signed into Your CheapTickets account when completing an Eligible Flight booking, You will automatically receive CheapCash for that Eligible Flight booking. CheapCash will be awarded only to the account of the CheapCash member who made the Eligible Flight booking; additional individuals named as travelers on the itinerary will not earn CheapCash. If booking a trip for another individual as a travel arranger, the Program account linked to the Member ID used to book the travel will earn CheapCash for the Eligible Flight booking.
For each Eligible Flight booking You make as a Program member (whether by enrolling on the "Checkout: Review and book" page or by being signed into an account that has already registered to be a CheapCash Program member), You will earn CheapCash in the amount specified at the time of booking, up to a maximum earn of $100 in CheapCash annually per member, unless otherwise specified in the terms and conditions of any offer awarding bonus CheapCash. CheapCash will only be earned for the original Eligible Flight booking, and not for any changes made to Eligible Flight bookings.
CheapTickets may periodically conduct additional offers enabling Program members to earn bonus CheapCash. The earning, redemption, and expiration dates of the bonus CheapCash earned from such offers are governed by the terms of each individual offer.
After completing an Eligible Flight booking, CheapCash earned for that Eligible Flight booking (other than any bonus CheapCash earned pursuant to a then-active offer) will be immediately deposited in Your account. You can view Your CheapCash balance in the "My CheapCash Activity" section of Your "My Account" page. If You cancel an Eligible Flight booking for which You had earned CheapCash, any CheapCash earned from that Eligible Flight booking will be deducted from Your CheapCash balance. Each net refund transaction's information (details) should appear under the "My CheapCash Activity" tab.
If Your CheapCash account does not represent the correct amount of CheapCash that You should have been awarded as determined by CheapTickets, CheapTickets reserves the right to adjust Your CheapCash balance. If You believe Your CheapCash account has been the subject of any suspicious activity, please contact CheapTickets Customer Service immediately. If it is determined You have been the victim of a fraud, the CheapCash You have earned will be transferred to a new CheapCash account.
Redeeming CheapCash
CheapCash earned on a flight booking may be used towards any CheapCash Hotel booking with a check-in date (a) 48 hours after you booked the flight on which the CheapCash was earned, or (b) on the departure date of the flight booking, whichever is earlier. If you attempt to use CheapCash on a CheapCash Hotel booking that does not meet the foregoing conditions, You may not be able to apply some or all of Your CheapCash to that CheapCash Hotel booking. CheapCash Hotels are designated in hotel search results by an "CheapCash applied" message for that hotel.
When booking a CheapCash Hotel, You will have the option to use all Your CheapCash to pay for part or all of the booking (if Your CheapCash balance is greater than amount due). If You choose to use Your CheapCash, we will subtract the amount of the CheapCash You are redeeming from the total amount due for Your CheapCash Hotel booking. If You choose not to use Your CheapCash, they will remain in Your account for future use, subject to any expiration. CheapCash with the earliest expiration date will be redeemed first.
If You make a multiple room booking and You choose to use Your CheapCash, Your CheapCash will be deducted from the total cost of the booking. CheapCash applied to multiple room bookings cannot be selectively applied to any one room but are applied to the overall total cost of the CheapCash Hotel booking. In this event, if You subsequently cancel one or more rooms in the multiple room booking, and if You are entitled to a refund, the amount refunded to You will be the cost of the particular room canceled less the amount of CheapCash proportionally applied across all rooms. The amount of CheapCash proportionally applied to the canceled room will be refunded to Your account.
If You choose to redeem CheapCash, then the CheapCash will be deducted from Your CheapCash balance immediately.
If You cancel a refundable reservation at a CheapCash Hotel paid in part by CheapCash, the CheapCash used for the CheapCash Hotel booking may be re-issued to Your account with their original expiration date. If the CheapCash used for the CheapCash Hotel booking expired prior to your cancellation of the CheapCash Hotel booking, the CheapCash will not be refunded to your account. CheapCash redeemed on a non-refundable reservation at a CheapCash Hotel will not be re-issued to your account under any circumstances. CheapCash cannot be used to pay or offset any cancellation fee. All bookings and cancellations are governed by the CheapTickets Terms and Conditions and any separate hotel policies that may apply.
CheapCash cannot be redeemed for cash. CheapCash may not be assigned, sold, transferred, and/or pledged to any third party or to another account. You have no property rights or other legal interests in CheapCash. You are responsible for any personal tax liability that may be related to participation in the CheapCash Promotional Program and redemption of any CheapCash.
Expiration of CheapCash
CheapCash awarded pursuant to the Best Price Guarantee program (see terms here ) expire 365 days after issuance. The expiration of all other individual awards of CheapCash will vary. Please check the expiration dates listed for each separate award of CheapCash in the "My CheapCash Activity" section of "My Account." Expiration occurs at 11:59 p.m. Central on the date listed. If Your account is deactivated, CheapTickets reserves the right to expire all of Your CheapCash. Once CheapCash have expired, they cannot be reinstated under any circumstances.
Changes to CheapCash Terms & Conditions
CheapTickets may change or cancel the CheapCash Program rules, CheapCash Program benefits, and these Terms and Conditions at any time without prior notice. These changes may affect the value of CheapCash already earned. CheapTickets reserves the right to terminate the CheapCash Program, or any part thereof, in any jurisdiction, at any time, with or without notice, even though such termination may affect the right to earn CheapCash or redeem CheapCash, or the value of previously earned CheapCash. CheapTickets is not liable to CheapCash members in any way for any value or benefits members may lose as a result of any changes made to the Program. It is the responsibility of members to check the CheapTickets.com website regularly for any changes to the Terms and Conditions of the Program. Continued membership in the CheapCash Program will be deemed as acceptance of the current Program Terms and Conditions. Any previous versions of the CheapCash Program Terms & Conditions are null and void.
Fraudulent Activity
CheapTickets has the right to monitor all Program members' account activity. If Your CheapCash account shows signs of fraud, abuse, or suspicious activity, CheapTickets may, in its sole discretion, close or freeze Your CheapCash account immediately, and You may lose some or all of Your earned CheapCash, including any CheapCash earned through fraudulent bookings. Examples of fraud, abuse, or suspicious activity include but are not limited to breaching these Terms and Conditions; engaging in any illegal or fraudulent conduct or activities with respect to the earning or redeeming of CheapCash; supplying or attempting to supply false or misleading information to CheapTickets or a travel supplier; making a misrepresentation to CheapTickets or a travel supplier; or selling, assigning, transferring, or acquiring, or offering to sell, assign, transfer, or acquire, any CheapCash. To contest freezing of an account or the cancellation of CheapCash, please call Customer Service.
If You have conducted any fraudulent activity, we will close Your account, You will forfeit all Cheapcash in Your account, and You will not be allowed to participate in the CheapCash Program in the future. CheapTickets also reserves the right to take any necessary legal action, and You may be liable for monetary losses to CheapTickets, including litigation costs and damages.
Liability
CheapTickets acknowledges that certain laws imply terms, conditions, or warranties into contracts for the supply of products or services that cannot be excluded. Except as provided in any law which cannot lawfully be excluded or modified by agreement, CheapTickets and any of their officers, employees, or agents are not liable for any loss or claim of any kind (including, without limitation, consequential or economic loss or loss of profits) with respect to the breach of any of these CheapCash Terms and Conditions by any person, or for any death or injury or consequential loss or damage arising from the supply or redemption of CheapCash or any other of Your benefits save to the extent that such loss or claim arises from the willful misconduct of CheapTickets or any of their officers, employees or agents.
Disputes and Other Terms
CheapTickets is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue claims as explained in this section.
You agree to give us an opportunity to resolve any disputes or claims relating in any way to the Program, the Website, the Services, any dealings with our customer service agents, any services or products provided, any representations made by us, or our Privacy Policy ('Claims') by contacting CheapTickets Legal: Arbitration Claim Manager, at 333 108th Ave N.E. Bellevue, WA 98004. If we are not able to resolve your Claims within 60 days, you may seek relief through arbitration or in small claims court, as set forth below.
Any and all Claims will be resolved by binding arbitration, rather than in court, except you may assert Claims on an individual basis in small claims court if they qualify. This includes any Claims you assert against us, our subsidiaries, travel suppliers or any companies offering products or services through us, including Providers, (which are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted these Terms, regardless of whether prior versions of the Terms required arbitration.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including statutory damages, attorneysrsquo; fees and costs), and must follow and enforce these Terms as a court would.
Arbitrations will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA Consumer Rules. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules, except as provided in this section. If your total Claims seek less than $10,000, we will reimburse you for filing fees you pay to the AAA and will pay arbitrator's fees, unless the arbitrator determines your Claims are frivolous. You may choose to have an arbitration conducted by telephone, based on written submissions, or in person in the state where you live or at another mutually agreed location.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your Claims to CheapTickets Legal: Arbitration Claim Manager,' at 333 108th Ave N.E. Bellevue, WA 98004. If we request arbitration against you, we will give you notice at the email address or street address you have provided. A party requesting arbitration must also provide a copy of the request to the AAA, at Case Filing Services, 1101 Laurel Oak Road, Suite 100, Voorhees, NJ 08043 or online at www.adr.org or at any AAA office.
Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a Claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. The Federal Arbitration Act and federal arbitration law apply to this agreement. An arbitration decision may be confirmed by any court with competent jurisdiction.
These Terms & Conditions, and the Website Terms and Conditions, govern Your participation in the CheapCash Program, and by participating in the CheapCash Program, You agree to be bound by these Terms & Conditions and the Website Terms and Conditions.
